1. Agreement to These Terms

These Terms of Use (“Terms”) govern your access to axionresearchpeptides.com (the “Site”) and your purchase of products from Axion Research Peptides (“Axion”, “we”, “us”), 8206 Louisiana Boulevard NE, Albuquerque, NM 87113, USA. By using the Site or placing an order, you agree to these Terms, our Privacy Policy, Research Use Only Policy, Shipping and Returns page and Return and Refund Policy. If you do not agree, do not use the Site or place an order.

2. Eligibility

  • You must be at least 21 years old.
  • You must be a qualified researcher, or purchase on behalf of a laboratory, institution or organization engaged in lawful research, and have the training and facilities to handle research materials safely.
  • You must have authority to bind any organization on whose behalf you order.
  • You must not be prohibited from receiving our products under applicable law.

We may request verification of eligibility and may refuse or cancel any order at our discretion.

3. Research Use Only Attestation

By placing an order you represent, warrant and agree that:

  • you are purchasing the products solely for laboratory research use;
  • the products will not be used in or on humans or animals, and will not be administered, ingested, injected, applied or otherwise used for human or veterinary purposes;
  • you will not resell, repackage or redistribute the products for consumer use, or incorporate them into any drug, supplement, food or cosmetic;
  • you are solely responsible for knowing and following all federal, state and local laws applicable to your purchase, possession and use; and
  • you will handle, store and dispose of the products safely and in accordance with applicable regulations.

4. No Human or Veterinary Use; No Medical Claims

Our products are not drugs, dietary supplements, foods or cosmetics, and have not been evaluated or approved by the U.S. Food and Drug Administration. They are not intended to diagnose, treat, cure or prevent any disease. Nothing on the Site is medical advice, and we provide no dosing, administration or outcome guidance. Information about compounds is provided as scientific reference only.

5. Orders, Invoices and Payment

  • Placing an order is an offer to purchase. We accept an order when we issue an invoice or ship it, and we may decline or cancel any order, including for suspected fraud, eligibility concerns, errors or supply limits.
  • Payment is by invoice issued through Mercury, payable by card or ACH. Invoices are due within 2 days of issue, and unpaid orders are cancelled after the due date.
  • We process and ship orders after payment is confirmed. Orders placed before 12:00 PM MT ship the same business day; later orders ship the next business day.
  • Please contact us first to resolve any concern about a charge.

6. Pricing and Availability

Prices are in U.S. dollars and may change without notice. We may correct pricing, description or availability errors, including after an order is placed. Prices do not include shipping or sales tax. We do not collect sales tax at this time, and the buyer is responsible for any applicable use tax. Product images and descriptions are for identification and may not reflect exact packaging.

7. Shipping, Risk of Loss and Customs

Shipping terms are described on our Shipping and Returns page. Delivery dates are estimates. You are responsible for providing a correct, staffed delivery address, for receiving and properly storing products on arrival, and for any applicable duties or import requirements.

8. Returns and Refunds

Returns and refunds are governed by our Return and Refund Policy.

9. Product Information and Quality

We test our products and make Certificates of Analysis available as described on the Site. Specifications may vary between batches within stated limits. You should independently verify that a product is suitable for your research.

10. Intellectual Property

The Site and its content, including text, graphics, logos and the “Axion Research Peptides” name, are owned by or licensed to us and protected by law. You may not copy, reproduce or exploit them without written permission, except for personal, non-commercial reference.

11. Acceptable Use of the Site

You agree not to misuse the Site, attempt unauthorized access, interfere with its operation, use automated tools to scrape it, submit false information, or use it for unlawful purposes.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We make no warranty regarding results of any research or suitability for any particular use. Any purity or quality remedy is limited to that stated in the Return and Refund Policy.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AXION AND ITS OWNERS, OFFICERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR RESEARCH RESULTS, ARISING FROM THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to defend, indemnify and hold harmless Axion and its owners, officers, employees and suppliers from claims, losses, liabilities and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse or unlawful use of the products, or your violation of any law or third-party right.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. Subject to any mandatory law, the state and federal courts located in Bernalillo County, New Mexico have exclusive jurisdiction, and you consent to that jurisdiction.

16. Termination

We may suspend or terminate access to the Site or refuse service at any time, including for breach of these Terms.

17. Changes to These Terms

We may update these Terms from time to time. The updated version applies from the date posted. Continued use of the Site after changes means you accept them.

18. General

If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. These Terms and the policies referenced above are the entire agreement between you and Axion regarding the Site and your purchases.
